Flowgolem Terms of Use

Welcome to Flowgolem! These Terms of Use ("Terms") govern your access to and use of the Flowgolem website, platform, tools, and services (collectively, the "Service"), operated by Halfborg Software ("Flowgolem," "we," "us," or "our").
Please read these Terms carefully before using the Service. By accessing or using the Service, creating an account, or clicking "I agree" (or similar button or checkbox), you signify your agreement to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.
1. Description of Service
Flowgolem provides a suite of online tools designed to help users create AI Spokesperson Videos. Key functionalities include:
Product to script: Generates dialogue script variations based on a provided product page URL.
Script to voice: Converts text scripts into audio voiceovers using selected AI voice models.
Generate AI spokesperson image: Creates avatar images of AI spokespersons.
Animate avatar: Animates avatar images to simulate speaking.
Lip sync avatar video: Synchronizes animated avatar videos with generated voice audio files.
The Service allows users to proceed through these tools sequentially, using the output of one tool as the input for the next, to generate a final AI spokesperson video. Access to and use of these tools consumes Credits, as described in Section 4.
2. User Accounts
Registration: To access most features of the Service, you must register for an account. You can register using an email address and password, or through a third-party service like Google Sign-In.
Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Security: You are responsible for safeguarding your account password and any other credentials used to access the Service. You are responsible for all activities that occur under your account.
Eligibility: You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service.
3. Use of the Service
License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or business purposes.
Workflow: The Service is designed for users to utilize the tools in a sequential manner. The output generated by one tool serves as the input for the subsequent tool in the creation process.
Prohibited Uses: You agree not to use the Service in any way that violates any applicable laws or regulations, or to generate content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
4. Credits, Payments, and Billing
Access to and use of the tools within the Service requires Credits. Specific actions will deduct a predetermined number of Credits from your account balance. All purchases of Credits are final and non-refundable, except as required by law.
5. Intellectual Property Rights
The Service and its entire contents are owned by Flowgolem, its licensors, or other providers. You retain ownership of your original content provided as input, but grant Flowgolem a license to use it for operating the Service.
6. User Content
You are solely responsible for your User Input and assume all risks associated with its use.
7. Termination
You may terminate these Terms at any time by ceasing all use of the Service. We may suspend or terminate your access at any time, with or without cause.
8. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FLOWGOLEM DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
9. Limitation of Liability
IN NO EVENT WILL FLOWGOLEM BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR FOR ANY AMOUNTS THAT EXCEED THE FEES PAID BY YOU DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION.
10. Indemnification
You agree to indemnify and hold harmless Flowgolem from claims arising out of your use of the Service or violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Your continued use constitutes acceptance of those changes.
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Singapore. You agree to submit to the jurisdiction of the courts in Singapore.
13. Miscellaneous
These Terms constitute the entire agreement between Flowgolem and you concerning the subject matter hereof.
